What Happened at the Nippon Dynawave Mill?
The disaster occurred during the morning shift change at Nippon Dynawave Packaging’s pulp and paper mill along Industrial Way in Longview.
A large storage tank containing “white liquor,” a highly caustic chemical solution used in the pulping process, suffered a complete structural failure. State officials said the tank could hold about 900,000 gallons and was about two-thirds full when it failed.
The collapse released a large amount of the chemical and caused serious damage near where workers had gathered. Dangerous conditions and worries about the remaining structure made rescue and recovery efforts more difficult.
In the end, eleven workers lost their lives, and others suffered chemical burns, breathing injuries, and other trauma.
The Cause Remains Under Investigation
The exact cause of the tank’s failure has not yet been determined.
The Washington Department of Labor & Industries and the U.S. Chemical Safety and Hazard Investigation Board are investigating the disaster. Environmental authorities are also evaluating the facility’s compliance with applicable air, water-quality, hazardous-waste, and industrial-safety requirements.
These investigations may examine questions involving:
- The tank’s design, age, condition, and maintenance history
- Inspection and repair procedures
- Corrosion or structural deterioration
- Chemical-processing and storage practices
- Workplace safety policies and training
- Whether warning signs were overlooked
- The location of employee work and gathering areas
- Emergency planning and response procedures
- The conduct of outside contractors, inspectors, manufacturers, or maintenance companies
No final conclusions can be made until the investigations are finished. Still, workers and families do not have to wait for a government report before talking to an attorney or preserving important evidence.
What Is White Liquor?
White liquor is an alkaline chemical mixture used to separate wood fibers in paper production. It usually contains sodium hydroxide and sodium sulfide, and it can be very corrosive.
Direct contact or significant exposure may cause:
- Serious chemical burns
- Eye injuries or vision damage
- Respiratory irritation
- Throat and lung injuries
- Skin damage
- Nausea, headaches, or dizziness
- Psychological trauma following a catastrophic event
If you have unusual or ongoing symptoms, you should get medical attention. This is not medical advice, and the effects of exposure depend on the type, amount, length of exposure, and the person involved. If you believe you have been exposed, please consult a doctor.
Potential Legal Rights Following an Industrial Disaster
Cases involving industrial disasters can touch on several areas of law. Workers’ compensation may offer some benefits to injured employees and families, but it is not always the only way to seek recovery.
Depending on what investigators find, there may also be claims against outside companies that designed, made, inspected, maintained, or repaired the failed tank and related systems.
Potential legal matters may include:
- Workers’ compensation benefits
- Third-party negligence claims
- Defective equipment or product claims
- Wrongful-death claims
- Chemical-exposure claims
- Claims involving contractors or maintenance providers
- Loss-of-consortium or family-related damages
Every situation is unique. Whether a claim is possible depends on the facts, the person’s connection to the facility, and who may have played a role in the disaster.
Compensation That May Be Available
Depending on the situation, injured workers and families may be able to seek compensation for:
- Emergency medical treatment
- Hospitalization and ongoing care
- Chemical-burn treatment
- Rehabilitation and therapy
- Lost wages
- Reduced future earning ability
- Physical pain and suffering
- Emotional and psychological trauma
- Funeral and burial expenses
- Loss of financial support
- Loss of companionship and guidance
- Other disaster-related losses
No attorney can guarantee a specific outcome. A thorough investigation is needed to find out what legal options are available.
Why These Cases Require a Thorough Investigation
Disasters, like a tank failure, can involve years of maintenance records, inspection reports, engineering decisions, contractor agreements, internal messages, and regulatory documents.
Important evidence may include:
- Tank inspection and maintenance records
- Engineering reports
- Photographs and surveillance footage
- Workplace safety complaints
- Employee and witness accounts
- Training and operating procedures
- Contractor work records
- Chemical-processing data
- Regulatory citations and inspection findings
- Emergency-response communications
Cross Monumental can team up with engineers, safety experts, chemical exposure specialists, medical professionals, and others to find out what happened and who may be responsible.
Steps Workers and Families Can Take
After a tragedy, legal issues may not be your first concern. Still, taking a few practical steps can help keep important information safe:
- Obtain appropriate medical care and follow-up treatment.
- Keep medical records, bills, and exposure-related documentation.
- Preserve photographs, videos, clothing, or personal equipment when safe to do so.
- Write down what you remember while the details remain fresh.
- Save communications from employers, insurers, contractors, or government agencies.
- Avoid signing a release or final settlement without understanding its effect.
- Speak with an attorney before important evidence becomes unavailable.
Families should put their health, safety, and each other first. An attorney can take care of the investigation and legal work.
